Conflicto suscitado entre los Juzgados Primero Civil del Circuito y Promiscuo de Familia de Melgar.
La controversia se generó en razón del factor funcional dentro del trámite de consulta de una sanción por desacato, y en virtud de las distintas interpretaciones que efectuaron las autoridades judiciales involucradas frente al principio de perpetuatio jurisdictionis y la figura del superior jerárquico de que trata el artículo 52 del Decreto 2591 de 1991.
La Corte dirime el asunto con la remisión del expediente al Juzgado Primero Civil del Circuito de Melgar, para que de manera inmediata resuelva la consulta de la referencia.
